以下人员应被归类为德克萨斯州居民，并有权在所有高等教育机构支付居民学费. 
(1)有下列行为的人:

• (A)毕业于本州的公立或经认可的私立高中, 作为高中毕业的替代选择, 在本州获得了相当于高中文凭的学历, 包括成功完成非传统的中等教育和
• (B)在该州连续居住:
  • (i)紧接毕业日期或收到同等文凭日期之前的三十六个月, as applicable; and
  • (ii)该人在某院校注册的学期的普查日期之前的12个月.
   

(二)有下列情形的人:

• (A) established domicile in this state not less than 12 months before the census date of the academic semester in which the person enrolls in an institution; and
• (B)在该个人入读某一机构的学期的人口普查日期之前的12个月内，连续在该州有住所.

(三)其父母:

• (A) established domicile in this state not less than 12 months before the census date of the academic semester in which the person enrolls in an institution; and
• (B)在该个人入读某一机构的学期的人口普查日期之前的12个月内，连续在该州有住所.
